Tallahassee, FL — The Florida House and Florida Senate agreed to several elements of the 2022 Tax Package, including a one year tax break on children’s diapers. This is inspired by the advocacy of Representative Anna V. Eskamani and is an integration of her bill, House Bill 85. Here is Representative Eskamani’s statement in response: 
 
“As Ranking Member of the Ways & Means Committee I am committed to making life easier for working families and everyday people in Florida. That’s why I am thrilled to see a one year tax break on the sale of children’s diapers be integrated into the 2022 Florida Tax Package. Disposable diapers can cost families more than $70 per month, creating significant cost burden for low income families and cannot be purchased with food stamps either. This is a success for Florida’s families and our ultimate goal is to make this tax break permanent. I want to give thanks to Chair Bobby Payne for his support of this effort, and thank diaper banks across the state for their advocacy.”

Frequent Q&A

When does the tax break go into effect?: Governor DeSantis signed the 2022 Tax Package into law on May 6, 2022 and this tax break will be applied from July 1, 2022 – June 30, 2023.

Will it apply to cloth diapers and all brands?:  This tax break should apply to all children’s diapers purchased in Florida, including all brands and all types.

Will it apply to online shopping?: Yes, now that Florida collect online sales tax this tax break should also apply to online sales made in Florida.

How about adult diapers?: Though our original bill is a permanent tax break on all types of diapers, the current tax break only applies to children’s diapers and is for one year. Our goal next legislative session is to expand this tax break, and make it permanent.
